Texas rules already in effect

DSHS reinstated its controlled-substance definitions effective July 31, 2026. Do not use the old Delta-8 injunction as a current permission to sell. Inspect the dated scheduling notice.

The consumable-hemp rules and controlled-substance schedules are different sources. Product testing, age restrictions, labeling and the treatment of smokable products require their own checks. The regulation guide connects those questions to the agency’s current rule register.

Federal changes: two dates, different provisions

Public Law 119–37, §781 originally schedules the revised federal hemp definition for November 12, 2026. The later §2019 of Public Law 119–103 limits the amendments’ application until December 11, 2026, except for the specified nonnaturally occurring cannabinoid exclusions in paragraphs (1)(C)(ii)(I) and (1)(C)(iv)(I). Do not reduce the two provisions to a single blanket delay. Read §781 and §2019.
