THC Concentrates, Vapes & Edibles in Texas: Which Rules Apply?
The short answer
A marijuana-flower penalty chart cannot answer every question about a THC cartridge, oil or edible. Check the alleged substance, its composition, the statutory provision and whether a lawful medical or hemp framework applies. The Controlled Substances Act defines marijuana and lists separate penalty-group provisions.

Separate the product from the legal category
| Product description | Source to inspect |
|---|---|
| Marijuana plant material | Health and Safety Code §481.121 |
| Concentrated THC or an alleged controlled-substance mixture | §§481.103 and 481.116, definitions and any applicable exception |
| Prescribed low-THC medical product | Compassionate Use Program and the prescription framework |
| Consumable hemp product | DSHS product rules and controlled-substance schedules |
Labels such as “legal THC,” “hemp-derived” or “medical grade” do not resolve those questions by themselves. Do not assume the weight of a cartridge or edible is treated like the same weight of flower.
E-cigarette sales have a separate rule
SB 2024 · 89R · Enacted · effective 2025-09-01. Restricted marketing and sale of specified e-cigarette products, including cannabinoid products; it is not a marijuana-flower possession statute. Official history.
A restriction on retail sales does not answer whether possession is an offense. Read the enacted text rather than treating a store’s advertising as legal clearance.
Medical use is its own framework
A prescribed formulation is not interchangeable with a smoke-shop vape. The medical program sets prescription and administration requirements. Start with the medical guide and ask the qualified prescriber about the authorized product and method.
If a product is involved in a charge
Ask a lawyer to review the actual charging document and relevant evidence. General product names do not establish laboratory composition or the alleged offense. Find county legal-service resources; do not send TCL case facts or confidential documents.
For ordinary flower thresholds, use the marijuana possession guide. For hemp scheduling, use the Delta-8 guide.
