Texas Marijuana Decriminalization: Local Policy vs State Law
The short answer
A local marijuana policy is not statewide legalization. Start by identifying who adopted it, which territory and agency it covers, and whether its current operation is established by a source. Texas’s possession statute remains a separate authority. Read §481.121.

Three policy types that should not be merged
| Policy type | Question to ask | What not to assume |
|---|---|---|
| Cite-and-release | Can the agency issue a citation for the alleged offense under its procedure? | A citation does not itself erase the allegation |
| Prosecutor diversion | Who is eligible, and what must a participant complete? | Eligibility or dismissal is not automatic |
| City enforcement ordinance | Which officers and territory does it govern, and is it enforceable now? | A city vote does not repeal state law |
These are three different policy types. Not every jurisdiction offers all three.
Start with documented local sources
Bexar County’s hub and Harris County’s hub retain the specific official local sources already reviewed by TCL. Read the program itself for scope and conditions. A matching page layout does not mean another county has the same policy.
Houston Proposition A research documents the proposed November 3, 2026 charter amendment. At this guide’s October 21 review, that election has not occurred. A proposal is not an adopted law; an eventual ballot result would still need a separate enforceability review.
How to assess a claim about your city
Find the ordinance, agency policy or prosecutor’s program document. Check the document’s date, amendments, eligibility rules and geographic jurisdiction. If a headline describes a lawsuit, locate the actual order and distinguish a temporary ruling from final disposition. If the current effect is not established, keep that uncertainty visible rather than claiming possession is legal.
Can county arrest data prove a policy worked?
No causal conclusion follows from a count alone. TCL’s enforcement data can show reported totals and population-normalized differences. It does not identify every agency decision, individual case pathway or reason for a change. Differences may reflect reporting or population as well as conduct and enforcement; the dataset does not resolve those explanations.
