How to Open a Cannabis Business in Texas: Licenses & Costs
The short answer
There is no single Texas “dispensary license” covering every cannabis business. Identify the business activity: medical dispensing, consumable-hemp retail, or manufacturing/distribution. Each has different regulators, applications and permissions.

Choose the correct licensing track
| Planned activity | Regulator and starting source | Key distinction |
|---|---|---|
| Medical low-THC cannabis dispensing | DPS Compassionate Use Program | Competitive organization licensing, not an ordinary retail registration |
| Retail sale of consumable hemp | DSHS licensing and registration | Hemp authority does not authorize medical dispensing |
| Manufacturing or distributing consumable hemp | DSHS product-license guidance | Check the activity-specific license rather than assuming retail coverage |
Medical organization applications
DPS’s application page describes a window from August 15 through September 15, 2025. That is historical application information, not an assertion that an application window is open now. Check DPS directly for a new opportunity. HB 46 provides for competitive evaluation and financial, security and operational requirements. Read §§4–8 of HB 46.
Licensing fees are not total startup costs
Application fees, license fees, facility requirements and working capital answer different questions. TCL has not verified a current comprehensive 2026 fee schedule or a representative startup budget. Check the regulator’s current instructions and ask for professional guidance before committing funds; an old fee in a blog post is not a reliable quotation.
Retail and product records are separate
The DSHS record guide exposes retail-registration and product-license location records independently. Review the activity authorized by the license and the product rules; do not buy a retail registration expecting permission to manufacture products or dispense prescribed cannabis.
The consumable-hemp regulation guide points to testing, labeling and rule sources. Product legality must be assessed separately from whether a business appears in a roster.
Research the county without treating records as market size
Use county hemp-location records to inspect reported physical locations and source fields. The counts are neither independently verified open competitors nor proof of local demand. Retailer-name analysis explains why a familiar business name also needs careful matching.
