Is Delta-8 Legal in Texas? The July 2026 Rule Change
The short answer
Do not treat Delta-8 as lawful in Texas on the strength of old injunction coverage. DSHS lists a reinstatement of its tetrahydrocannabinol and marijuana-extract definitions effective July 31, 2026. Read the official scheduling notice.

What changed?
The agency’s posted position follows the Texas Supreme Court’s May 1, 2026 decision in DSHS v. Sky Marketing Corp., No. 23-0887. The court reversed the temporary injunction and distinguished manufactured, potent Delta-8 products from the naturally occurring trace amounts in a hemp plant. It did not hold that every naturally occurring trace is prohibited. Read the opinion, especially pages 25–30. This is a different question from whether a retailer has a DSHS registration. This records the agency’s posted scheduling action and the cited decision, not an exhaustive search of every later docket or a product-specific legal conclusion. For a particular substance, use the actual schedule’s definition rather than assuming every marketing term is a precise chemical or legal category. Why does older information say it was legal?
A dated court ruling can describe an earlier stage of litigation. It does not establish that the same restriction is suspended today. Look for the later decision, the agency’s implementation notice and its effective date. The DSHS register explicitly links its reinstatement to the Texas Supreme Court’s May 1, 2026 opinion.
Does a hemp-store registration change the answer?
No registration record certifies a store’s entire inventory. TCL’s hemp directories show dated registration and product-license location records, not product approvals. A source status of “Current” is a license-record field; it is not independent proof that each cannabinoid on a shelf complies with the law.
What about CBD, Delta-9 drinks or medical cannabis?
Those need separate analysis. The CBD guide, THC beverage evidence and medical program guide point to the relevant sources. Do not turn a Delta-8 restriction into an unsupported claim that every hemp or prescribed product has the same status.
